Dozens of businesses—including Revlon Consumer Products Corp.—have submitted similar filings since late October as the court deliberates on the legality of Trump’s tariff framework, which was questioned by several justices during November hearings.

Retailers have faced persistent cost volatility throughout 2025, particularly across non-food imports. While exemptions and rate adjustments have softened the overall blow, categories such as electronics, apparel, and selected consumer goods have experienced higher landed costs. Costco, like many operators, has adjusted sourcing, accelerated ordering cycles and shifted merchandising to offset tariff impacts.

THE WHY? With a Supreme Court ruling pending, major retailers are seeking legal protection to recover potentially unlawful tariff payments—an issue with downstream implications for retail pricing, supply-chain planning and cost management across multiple categories, including beauty and personal care imports.
